1. Acceptance of Terms

By accessing or using the electronic program guide (“EPG Service”) provided by EPGTV.NET (“Provider,” “we,” “us,” or “our”), you (“Customer,” “User,” “you,” or “your”) agree to be bound by these Terms of Service (“Terms”). If you are entering into these Terms on behalf of a business or other legal entity, you represent that you have the authority to bind such entity to these Terms. If you do not agree to these Terms, you must not access or use the EPG Service.

2. Description of Service

The EPG Service provides electronic programming information, schedules, and related data for television channels and streaming services. The Service is provided “as is” and “as available” for informational purposes only.

3. User Representations and Warranties

3.1 User confirmations

You expressly represent and warrant that:

  • You are at least 13 years old and will register only one account in our system using a non-disposable email address.
  • You will be responsible for safeguarding your password and any other credentials used to access the EPG Service and you will notify us immediately if any of those credentials is leaked or accessed by third parties so that we can generate a new set of credentials for your account.
  • You understand that there’s a 3 IP addresses restriction for every account.
  • If you will bundle our EPG Service with your own, you will use your own technology and infrastructure to provide EPG to your customers in a protected, secure and non-publicly-accessible way.
  • You take full responsibility for all actions and interactions with the EPG Service done using your credentials.

3.2 Legal Right to Channel Content. 

You expressly represent and warrant that:

      • You (whether an individual or business entity) possess all necessary legal rights, licenses, permissions, and authorizations to receive, view, and access the television channels and content for which you are using the EPG Service.

      • Your use of the EPG Service corresponds only to channels and content to which you have legitimate access through authorized subscriptions, licenses, or other legal means.

      • You will not use the EPG Service to access, organize, or display programming information for channels or content that you are not legally entitled to receive.

    3.3 Compliance with Laws. 

    You represent and warrant that your use of the EPG Service complies with all applicable local, state, national, and international laws, regulations, and copyright or broadcasting rights, including but not limited to telecommunications, broadcasting, and intellectual property laws.

    3.4 No resale rights.

    You expressly represent that the use of the EPG Service is not for resale. It can be used byyou as a home user or by you as an OTT or IPTV provider looking to add (bundle) EPG to their services however it won’t be resold as EPG Service to third parties and you won’t provide access to third parties to the files, data and information provided by the EPG Service other than the use it’s intended for.

     

    4. About Payments and Refunds

    We use PayPal to process all payments, which is a reputable third party payment processor. We don’t have access to your payment information other than the transacion ID and the paid amount. Due to the nature of our services all sales are final. We may, at our sole discretion, issue a refund (partial or in full) if we decide to stop providing the EPG Service or if we can no longer support the country or countries you’ve signed up for.

    5. Limitation of Liability and Indemnification

    4.1 No Provider Liability. The Provider acts as a passive conduit of publicly available or licensed programming data. The Provider shall not be held responsible or liable for any use, misuse, or application of the EPG Service by the Customer or any third party. The Provider does not guarantee the accuracy, completeness, or timeliness of the data provided.

    4.2 Customer Responsibility for Liability. You are solely and entirely responsible for any and all liability, claims, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising from or related to:

        • Your use or inability to use the EPG Service.

        • Your breach of the representations and warranties in Section 3.

        • Your violation of any law, regulation, or third-party rights (including intellectual property or broadcasting rights) in connection with your use of the EPG Service.

        • Any dispute between you and any channel broadcaster, content provider, or service distributor regarding your rights to access channel content.

      4.3 Indemnification. You agree to defend, indemnify, and hold harmless the Provider, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the EPG Service, including, but not limited to, any claim that your use of the EPG Service infringed the rights of a third party or violated applicable law.

      6. Disclaimer of Warranties

      THE EPG SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. THE PROVIDER DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

      7. Intellectual Property

      We respect the intellectual property of third parties and urge our customers to do the same. We do not claim ownership of the information included in the files provided along the EPG Service including texts, images or any other content. All the content included with the EPG Service is -at the best of our knowledge- provided by third parties licensed to distribute such content. If you think that our service or any part of it violates your Intellectual Property rights please contact us immediately and we will take the proper actions to ensure that the infringing content is removed as fast as techinically possible from our systems. 

      8. Termination

      We reserve the right to suspend or terminate your access to the EPG Service immediately, without prior notice or liability, if we believe, in our sole discretion, that you have violated any provision of these Terms, including the representations and warranties in Section 3.

      9. General Provisions

      7.1 Modification of Terms. We reserve the right to modify these Terms at any time. Continued use of the EPG Service after such changes constitutes your acceptance of the new Terms.
      7.2 Governing Law and Jurisdiction. These Terms shall be governed by the laws of [State/Country], without regard to its conflict of law provisions.
      7.3 Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
      7.4 Entire Agreement. These Terms constitute the entire agreement between you and the Provider regarding the EPG Service and supersede any prior agreements.

      By using the EPG Service, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, including the critical liability and indemnity obligations in Section 5 and the legal access representations in Section 3.
